  1. Something completely different, anon-prosser: is it possible to challenge a fitness to plead application? I'm thinking of this story, Handler may be let off ....

  2. For the prosection to challenge it? Of course. The court decides the issue having heard the evidence -- the Crown is entitled to demonstrate that the person is fit to plead. It's quite a high threshold to cross, and I've seen some very disturbed people being declared fit to plead.

    Whether or not the Crown will challenge it in this case remains to be seen.

  3. It is the RSPCA who are prosecuting.

    I was expecting them to accept a caution and the whole thing to be swept under the carpet.

    As to not challenging. The next court appearance is within three weeks.

    Could it be only me or does it look like a few of the comments look as if they are coming from brain dead people?
